    AMENDMENTS TO BALDWIN COUNTY SUBDIVISION REGULATIONS

    NOTICE IS HEREBY GIVEN that the Baldwin County Commission, during its September 19, 2023, regular meeting, will consider approving amendments to the Baldwin County Subdivision Regulations after a Public Hearing, pursuant to Article 12 of the Baldwin County Subdivision Regulations. The September 19, 2023, regular meeting of the Baldwin County Commission will be held at the Baldwin County Fairhope Satellite Courthouse, County Commission Meeting Chambers-2nd Floor, 1100 Fairhope Avenue, Fairhope AL 36532.

    The Baldwin County Commission meeting begins at 8:30 a.m. If you wish to be heard in opposition to or in favor of the proposed amendments during the Public Hearing, please be in attendance by
    8:30 a.m.

  • PUBLIC NOTICE

    Pursuant to § 22-27-48.1, Code of Alabama (1975), public notice is hereby provided that the Baldwin County Commission has received an application for local approval of new solid waste management facility. The Commission and/or the Baldwin County Waste Siting Board will consider the siting of a new solid waste management facility in Bay Minette, Alabama, which facility and location are further described below.  To review a copy of both the local solid waste management plan and the application, please visit, during normal business hours from 8:00 a.m. to 4:00 p.m., at the location referenced below:

    All interested citizens are invited to make public comments and to attend a public hearing on Tuesday, September 19, 2023, at 8:30 a.m. at the Baldwin County Commission Chambers on the 2nd floor of the Fairhope Satellite Courthouse located at 1100 Fairhope Ave. Fairhope, Alabama, at which time the following permitting application will be addressed:

    Permit Application for Construction and Demolition Disposal at the Redhill Landfill. The Red Hill Landfill is located at the end of Redhill Road Extension and does not currently accept solid waste of any kind. The proposed permit would allow for vertical expansion of the Red Hill Landfill to accept construction and demolition waste. The modification is being considered to accommodate continued growth and industrial expansion, providing adequate disposal services to all areas of the county. The property is within unincorporated Baldwin County.  It is owned and operated by the Baldwin County Commission through the Solid Waste Department. The application for this permit is consistent with the Baldwin County Comprehensive Solid Waste Management Plan.
    The local governing body shall make a discretionary decision to approve or disapprove the siting of the new facility. In determining whether to approve the siting of the new solid waste management facility, the local governing body shall consider the following criteria, outlined by § 22-27-48(c), Code of Alabama (1975):
    (1) The consistency of the proposal with solid waste management needs as identified in the solid waste management plan.
    (2) The relationship of the proposal to local planned or existing development or the absence thereof, to major transportation arteries and to existing state primary and secondary roads.
    (3) The location of a proposed facility in relationship to existing industries in the state that generate large volumes of solid waste, or the relationship to the areas projected for development of industries that will generate solid waste.
    (4) Costs and availability of public services, facilities and improvements required to support a proposed facility and protect public health, safety, and the environment.
    (5) The impact of a proposed facility on public safety and provisions made to minimize the impact on public health and safety.
    (6) The social and economic impacts on the affected community, including changes in property values, and social or community perception.


    The application and approval process as provided in § 22-27-48.1, Code of Alabama (1975), is as follows:


    August 15, 2023 - Baldwin County Commission formally received application, approved Public Comment Period, Public Hearing and Public Awareness Meeting dates and advertisements.  Within 10 days, notice shall be provided to adjacent property owners via certified mail and to general public via, newspaper, public service announcements, and on the Baldwin County Commissions’ website, www.baldwincountyal.gov.


    September 15, 2023, 10:00 a.m. - Public Awareness Session, Baldwin County Commission Chambers, Administrative Building, 322 Courthouse Square, Bay Minette, Alabama, during which the applicant shall provide general information on the proposal and address questions and concerns of the affected community. Members of the public may submit written questions or comments germane to the proposal.


    September 19, 2023, 8:30 a.m. - Public Hearing and Public Comment Review at the Baldwin County Commission Chambers on the 2nd floor of the Fairhope Satellite Courthouse located at 1100 Fairhope Ave. Fairhope, Alabama. The public may submit written comments at any time up to the conclusion of the hearing. The local governing body shall have thirty (30) days following the Public Hearing to make its decision to approve or disapprove the proposal.


    If the application is approved, applicant shall petition the Circuit Court of Baldwin County, Alabama for a determination pursuant to § 22-27-48.1(i), Code of Alabama (1975), of whether the proper requirements and time frames were complied with, whether such approval is consistent with the solid waste management plan, and whether the proper criteria was considered.

    NOTICE IS HEREBY GIVEN that, for purposes of Section 147(f) of the Internal Revenue Code of 1986, as amended, the Infirmary Health System Special Care Facilities Financing Authority of Mobile, a public corporation organized under the laws of the State of Alabama (the “Authority") will hold a public hearing on behalf of the governing bodies of the City of Mobile, Alabama (the “City of Mobile"), Baldwin County, Alabama (“Baldwin County") and Mobile County, Alabama (“Mobile County") on Wednesday, April 3, 2024, at 11:00 a.m., accessible to the public by telephone, concerning a proposed plan of financing for the benefit of the Obligated Group described below.  The plan of financing will include the issuance by the Authority of its revenue bonds (the “Bonds") to provide financing for the benefit of Infirmary Health System, Inc., an Alabama nonprofit corporation (“IHS"), Mobile Infirmary Association, an Alabama nonprofit corporation (“MIA"), and Gulf Health Hospitals, Inc., an Alabama nonprofit corporation (“Gulf Health").  IHS, MIA and Gulf Health are the members of an Obligated Group (the “Obligated Group") under a master trust indenture and are responsible for the payment of the Bonds.  The members of the Obligated Group own and operate health care facilities in the City of Mobile, Mobile County and Baldwin County. 

    The Bonds are being issued in one or more series, at one or more times, in an aggregate principal amount of up to $350,000,000 (the “Maximum Amount") as part of a plan to finance or refinance certain health care facilities of the Obligated Group.  The plan may include the financing of costs of issuance, capitalized interest or working capital, as applicable rules and regulations permit.  All series of Bonds to be issued under the plan of financing will be issued within three years after the issue date of the first issue.  The proceeds of the Bonds will be made available to IHS and the other members of the Obligated Group and used for the purposes described below. 

    Proceeds of the Bonds will be used to refund all or a portion of certain outstanding indebtedness (the “Refunded Debt") issued for the benefit of the Obligated Group, including without limitation the Authority's Revenue Bonds (Infirmary Health System, Inc.), Series 2021B issued in the original principal amount of $20,000,000 and its Revenue Bonds (Infirmary Health System, Inc.), Series 2021C issued in the original principal amount of $50,000,000.  The Refunded Debt financed, refinanced or reimbursed costs of health care facilities operated by the Obligated Group at the locations listed below.   

    The capital improvements to be financed or refinanced (collectively, the “Project") may include hospital facilities, medical office buildings, outpatient clinics, building additions or renovations, new or replacement equipment and other capital expenditures for the integrated health care delivery system of IHS.  All or portions of the Project may be located at any one or more of the following locations where IHS operates its health care delivery system:

    (i)         the Mobile Infirmary Medical Center campus (including Infirmary LTAC Hospital located at the Mobile Infirmary campus), located at 5 Mobile Infirmary Circle, Mobile, Alabama;

    (ii)        the Thomas Hospital campus, located at 750 Morphy Avenue, Fairhope, Alabama;

    (iii)       the North Baldwin Infirmary campus, located at 1815 Hand Avenue, Bay Minette, Alabama;

    (iv)       clinic facilities of the Obligated Group located at 7101 Highway 90, Daphne, Alabama;

    (v)        clinic and free standing emergency department facilities of the Obligated Group at the Obligated Group's Saraland campus, located at 95 Shell Street, Saraland, Alabama; and

    (vi)       clinic and free standing emergency department facilities of the Obligated Group at the Obligated Group's Malbis campus, located at 29487 State Highway 181, which is in unincorporated Baldwin County.        

    Up to the entire Maximum Amount may be used for the Project at any one of these locations.

    The facilities that comprise the Project are or will be owned and operated by IHS, MIA, Gulf Health, Infirmary Health Hospitals, Inc. and/or their subsidiaries and affiliates (each of which is a member of the Obligated Group or an affiliate of IHS).

    The Bonds will be special or limited obligations of the Authority payable solely from payments by IHS pursuant to one or more loan agreements and corresponding notes, and payments by the Obligated Group pursuant to one or more master indenture obligations.  The Bonds will not be general obligations of the Authority and will not in any way constitute a debt, liability or obligation of the State of Alabama or any political subdivision of the State of Alabama, including without limitation, the City of Mobile, Baldwin County or Mobile County.  The Bonds will not be payable from any tax revenues.
